В статье исследуются ключевые проблемы судебной защиты прав участников долевого строительства в современных российских реалиях. Анализируются практики взыскания неустойки и тенденции судейского снижения или приостановления её начисления с учётом финансового состояния застройщиков, а также последствия для реальной компенсации потерь дольщиков. Отдельное внимание уделено процедурам банкротства застройщиков: показано, как включение компании в конкурсную массу переводит требования дольщиков в разряд обычных денежных требований и существенно снижает их шансы на возмещение средств, в том числе вследствие приоритета залоговых кредиторов и сложностей оформления требований в реестр кредиторов. Сделан вывод о необходимости корректировки правоприменительной практики и нормативных механизмов для обеспечения более справедливого баланса интересов дольщиков и строительных организаций.
The article explores the key issues of judicial protection of the rights of participants in shared construction in the current Russian realities. It analyzes the practices of collecting penalties and the trends of judicial reduction or suspension of their accrual, taking into account the financial condition of developers, as well as the consequences for the real compensation of losses of shareholders. Special attention is paid to the bankruptcy procedures of developers: it is shown how the inclusion of the company in the bankruptcy estate transforms the shareholders' claims into ordinary monetary claims and significantly reduces their chances of receiving funds, including due to the priority of collateral creditors and the difficulties of registering claims in the creditors' register. The conclusion is that it is necessary to adjust law enforcement practices and regulatory mechanisms to ensure a more equitable balance between the interests of shareholders and construction organizations.
