The article examines the institution of suspicion in criminal procedure as a complex and multifaceted legal phenomenon with significant theoretical and practical implications. Suspicion is analyzed as the initial stage in forming a hypothesis about a person’s involvement in a crime, based on a set of factual data. Particular attention is paid to the absence of a legal definition of this concept in criminal procedure legislation and the resulting scholarly debates. Drawing on both domestic and foreign approaches, the study reveals the essential features of suspicion, its dynamic nature, and its role within the mechanism of criminal prosecution. The importance of suspicion as a basis for applying procedural coercive measures is emphasized, provided that fundamental human rights and freedoms are respected. The article also explores the distinction between suspicion and accusation. It concludes that suspicion serves as an intermediate stage between the verification of crime-related information and formal charges, ensuring a balance between effective investigation and the presumption of innocence.
