The author of the article writes about surrogacy as a young but important phenomenon in medicine that can help those people who want to have children but cannot do so for a number of reasons become parents. The article discusses such criteria for the legality of surrogacy as the citizenship of the surrogate mother and the genetic parents. Failure to comply with such criteria makes surrogacy criminal. The author emphasizes that compliance with these legal norms guarantees the citizenship and protection of the Russian state to the born child. The article examines the judicial practice proving the criminality of surrogacy in cases where the surrogate mother or genetic parents are foreign citizens. The author comes to the conclusion about the international nature of some cases of criminal surrogacy and speaks about the need to counter such crimes at the international level. The study suggests ways to prevent and detect cases of criminal surrogacy involving citizens of foreign countries.
