The article examines the activities of the Federal State Unitary Enterprise (FSUE «Okhrana» of the Russian National Guard), a strategic enterprise under the jurisdiction of the Federal Service of Troops of the National Guard of the Russian Federation (hereinafter referred to as FSUE «Okhrana» of the Russian National Guard), which includes paramilitary and guard units. The article examines the issue through the prism of legal technique, in the context of legal concepts such as inspection, search, and inspection. The essence of the study lies in the disclosure of a «conflict of interest» between three legal entities: FSUE «Okhrana» of the Russian National Guard and citizens (workers) of a military-industrial complex enterprise, on the one hand, and citizens (workers) of a military-industrial complex enterprise and the management of the military-industrial complex enterprise (in this case, the Arzamas Machine-Building Plant), on the other. The essence of the conflict is the improper application of Article 11 of the Federal Law «On Departmental Security» by employees of the Federal State Unitary Enterprise «Security» of the Russian National Guard, as well as the management in their activities, of the instructions on the access and internal regime of JSC «Arzamas Machine-Building Plant», approved by the order of the Managing Director of JSC «AMZ» dated March 20, 2024. This instruction, in accordance with Russian law, cannot be classified, in accordance with Article 4 of the Federal Law «On Departmental Security», as part of other regulatory legal acts of the Russian Federation that employees of the Federal State Unitary Enterprise «Okhrana Rosgvardia» must adhere to in their activities, nor can it contradict those (regulatory legal acts). In light of the above circumstances, a legislative initiative is being introduced.
