An economic and legal model for the transition from utilization to marketable products and the preservation of natural resources

Abstract:
The article presents a practical model for transitioning from conventional landfilling of spent foundry sand (FKKO code 3 57 150 11 49 5) to its use as a marketable product. Based on a hypothetical case of interaction between a waste generator and a waste management operator, the study analyzes the moment of title transfer, the scope of the operator’s obligations towards the customer, and the legality of subsequent sand sales without the customer’s approval. It is concluded that, provided the contract is properly drafted and documented evidence of the waste’s morphology (waste passport, biotesting, hazard class) is available, the operator has the right to dispose of the waste independently, including selling it as a commodity. The proposed model can be extended to other types of industrial waste.
